After the initial 12 months of tenancy, if the tenant wants to move from their PBV unit, they shall receive a priority for a Housing Choice Voucher to move. If the tenant in a Project-Based unit moves out of the development during the first year of the lease, the tenant’s assistance ends. The rental subsidy in PBV assisted projects is attached to the building or unit for the term of the HAP Contract. When the project is ready for occupancy, the Housing Authority and the owner execute a HAP Contract for a term of up to 20 years of rental subsidy. Upon HACCC project award and HUD approval, the HACCC executes an Agreement with the building owner to enter into a Housing Assistance Payments (HAP) Contract. In these cases, PBV assistance can be awarded without the issuance of an RFP by HACCC. The Housing Authority selects projects for PBV assistance through a competitive Request For Proposals (RFP) issued by HACCC or it can accept projects in a non-competitive process whereby the project has already competed for funding from local, State or Federal programs within the past three years from the owner’s request for PBV assistance. Initial rents in PBV properties must not exceed 110 % of the Housing Choice Voucher Program Existing Fair Market Rents (FMRs). A housing authority may choose to provide Section 8 PBV rental assistance for up to 20% of its units under the Housing Choice Voucher Program (HCVP).
